Amendments to the Federal Law 170-FZ

The Federal Law of November 21, 1995 No. 170-FZ "On the Use of Atomic Energy" (Collection of Legislative Acts of the Russian Federation, 1995, No. 48, Article 4552; 2004, No. 35, Article 3607; 2007, No. 49, Article 6079; 2008, No. 30, Article 3616; 2011, No. 49, Article 7025) is to be amended as follows:

  1. Article 27:
      a) shall be enlarged with a new part 4, containing as follows: "Individuals, aspiring to the positions of specialists, envisaged in Section 2 of the Article, are obliged to be subject to compulsory preliminary medical examination upon entering employment, and the individuals admitted to work, stated in the Article, are obliged to be subject to periodic (within the labour activity) medical examinations, including chemico-toxicological analyses for the absence of narcotic drugs, mind-altering substances and metabolites thereof in vivo.";

      b) shall be enlarged with part 5 in the following wording: "Procedure of conduct of psychophysiological examinations, as well as medical examinations mentioned in Section 4 of the Article, and the format of the medical report on the presence (absence) of medical contra-indications shall be established by a federal executive body exercising functions on formulation of the State policy and statutory regulation in the sphere of healthcare service, as agreed upon with the State Atomic Energy Corporation ROSATOM.";

      c) Former part 4 is to be treated as part 6;

  2. Article 52 is to be stated in the new revision:

    "Article 52. Authorisation for Individuals to Work at Nuclear Installations, Radiation Sources, Storage Facilities, with Nuclear Materials or Radioactive Substances"

    Individuals may be authorised to engage in work at a nuclear installation, radiation source, storage facility, and work related to nuclear materials and radioactive substances if they meet appropriate qualification requirements.

    Individuals may be authorised to engage in work at a nuclear installation, radiation source, storage facility, and work related to nuclear materials and radioactive substances dealing with the State Secret, specified in the first part the Article, if they obtain an access to the State Secret, registered in accordance with the legislation of the Russian Federation dealing with the State Secret.

    Individuals cannot be authorised to engage in work at a nuclear installation, storage facility, and work related to nuclear materials or radioactive substances in case they have some of the listed medical contraindications, which may pose restrictions to their work at a nuclear installation, radiation source, storage facility, and work related to nuclear materials and radioactive substances.

    Individuals cannot be authorised to engage in the mentioned in the Article works:

    • in case they have unreimbersed or unexpunged conviction for intended crime;
    • in case they are mentioned in the list of organizations and individuals famous for their involvement in extremist activity or terrorism, in accordance with the Federal Law of August 7, 2001 No. 115-FZ "On Counter-acting Legalisation of Proceeds from Crime, and Terrorist Financing".

    Investigation of information, envisaged in part 4 of the Article, shall be carried out by the federal security service bodies.";

  3. The second part of the Article 61 shall be enlarged with a new paragraph:
    "authorisation for individuals to work at nuclear installations, radiation sources, storage facilities, and work related to nuclear materials or radioactive substances, in case they have unreimbersed or unexpunged conviction for intended crime, and in case they are mentioned in the list of organizations and individuals famous for their involvement in extremist activity or terrorism, in accordance with the Federal Law of August 7, 2001 No. 115-FZ "On Counter-acting Legalisation of Proceeds from Crime, and Terrorist Financing".
